Safeguards to protect children

The legal system has safeguards in place to protect children (under the age of 18) and a claim cannot be settled until a court has approved the amount of monies the responsible party wants to offer the injured child. Once the award has been approved, the court will then invest the monies in a court fund, which will accrue interest, until the child reaches the age of 18, at which point they can apply to the court to withdraw their money. A child who is involved in an accident (unless it is an accident on a boat, aeroplane or suffered injury as a victim of crime) have three years after reaching the age of 18 to pursue a claim.
